Terms of Service

These terms are issued by SmartGPX and are governed by French law (see "Governing law" below).

Agreement to these terms

By creating an account or using SmartGPX, you agree to these terms. If you don't agree, please don't use the service.

The service

SmartGPX offers two distinct things:

• Converting a Google Maps route into a GPX file: a paid, credit-based feature, available on the site.
• A set of free GPS format-conversion tools (GPX, KML, KMZ, TCX, FIT, GeoJSON) that run entirely in your browser. Your files are never sent to our servers.

Your account

You must provide a valid email address and are responsible for keeping your password confidential. An account is personal; don't share it. You must be at least 16 years old to create an account.

Credits and payments

• Only a successful Google Maps → GPX conversion consumes a credit. A failed conversion consumes none. The free tools never consume credits.
• Credits are purchased in packs through Stripe Checkout, at the prices shown at the time of purchase, and never expire: they stay on your account until you use them.
• Purchases are final. Credits are non-refundable, except where required by applicable law.
• Credits have no cash value and cannot be transferred, exchanged, or redeemed for cash.

Acceptable use

You agree not to:

• Circumvent or attempt to circumvent credit consumption;
• Automate bulk requests (scraping, bots) against the service;
• Use SmartGPX in a way that violates Google Maps' or the Google Routes API's own terms of use;
• Disrupt the service or attempt to access accounts that aren't yours.

Third-party services

Google Maps → GPX conversion depends on the Google Routes API; payments are processed by Stripe. SmartGPX is not responsible for the unavailability, errors, or changes of these third-party services.

SmartGPX is not affiliated with, endorsed by, or in any way officially connected to Google. Google Maps and Google Routes are trademarks of Google LLC. SmartGPX is an independent, unofficial application, developed and maintained separately from Google.

Intellectual property

The SmartGPX name, logo, and visual identity belong to us. The files you generate (GPX, KML, etc.) belong to you: we claim no rights over them.

Disclaimer

The service is provided "as is." Route data (distance, duration, and especially an automatically inferred travel mode) may be inaccurate or outdated; don't rely on it for safety-critical navigation.

Limitation of liability

To the extent permitted by applicable law, SmartGPX is not liable for indirect, incidental, or consequential damages arising from your use of the service.

Termination

We may suspend or terminate an account for violating these terms. You may stop using the service at any time.

Governing law

These terms are governed by French law. Any dispute relating to their interpretation or performance falls under the exclusive jurisdiction of the courts of Paris, subject to any mandatory consumer-protection provisions that apply.

Changes to these terms

We may update these terms from time to time; any material change will be reflected by a new "last updated" date at the top of this page.
